PAYMENT AND CANCELLATION POLICY
To make your stay as pleasant as possible, the Management of The Abode Resort & Spa requests your co-operation in observing the following payment and cancellation policies:

Deposit / Pre-payment:

Modes of payment can be in the form of Cash, Credit Cards or Bank Transfers, BIBD QuickPay and Pocket.

Payment for the entire stay duration is required within 24 hours of making the reservation, failing which, it will be automatically released.
-
If the period of stay is extended either prior or during the stay, full payment of the extended period must be received before the request for extension can be confirmed. Confirmation of extension is also subject to availability.

Cancellation:
-
Guests are allowed to request for a date change to their reservation up to two (2) times only. The request must be made more than seven (7) days prior to their original scheduled arrival date and subject to availability.

All cancellations made more than seven (7) days prior to the original scheduled arrival date will incur a 50% cancellation fee.
-
All cancellations made within seven (7) or less days prior to the original scheduled arrival date will incur a 100% cancellation fee.
-
Approved refunds will be made in the same mode that payment was received in and may take up to 30 days to process.

In exceptional circumstances, such as a documented medical emergency or force majure events, the resort management may at its sole discretion, offer one (1) date change or an amendment to the reservation. Payments made will not be refundable.

Amendment:

Amendment is defined as (1) changing names, and/or (2) increasing or decreasing the number of nights for the confirmed reservation.

If a reservation is amended within seven (7) or less days to the day of arrival, and it results in a shorter stay duration, the unutilised reservations will be considered a cancellation and any balance amounts will not be refundable.

Amendment made more than 7 days prior to arrival that results in a shorter stay, the balance amount will be credited to the room folio upon check-in for incidental spend. Any unused amount will not be refundable.

If an amendment results in a longer stay duration, then the balance amount owed will need to be paid in full before the amendment can be confirmed. Please note, confirmation is also subject to availability.

No Show:

Accommodation not occupied by 1600 hours (4 pm) on date of arrival will be considered as No Show, unless prior arrangement for late check-in has been made.

In an event of No Show, full pre-payment received will not be refunded.

RESORT POLICY
​To make your stay as pleasant as possible, the Management of The Abode Resort & Spa requests your co-operation in observing the following reservations policy.

Any extension of stay must be reconfirmed with the Front Desk, and is subject to tents’ availability.

Photo ID is required during check-in. For bookings using credit/debit card, the same card must be presented upon check-in.

Full payment is chargeable at the time of online booking reservation.

The Management of the The Abode Resort & Spa will not be held responsible for any property lost, damaged or misplaced within the premises. Please note that for added convenience, a safety box is provided in each Tent.
-
The maximum occupancy of guests at Superior Riverfront Tent is 4 persons while the Family Riverfront Tent is 12 persons, adults and children inclusive. Children under the age of 1 stay for free if using existing bedding. Please note that children 12 years and older are considered as adults.

Prior to your stay, an additional bed is obtainable upon request and subject to availability for Family Riverfront Tent only. Only one additional bed is permitted and chargeable at BND35.00 per night.

A security deposit of BND300.00 is required during check in and will be refunded on your departure date, once verification of the tented villa condition has been made.
-
BND25.00 charge applies for each key that is unreturned, lost or damaged.

Late check-out fees apply from 12:00 - 18:00 at 50% of published room rate. Full published rate applies after check-out from 18:00, subject to room availability.

Smoking is strictly prohibited at The Abode Resort & Spa or at areas within the premises not permitted by law. Smoking in the Tents will result in a BND300 fee charged to the occupying Guest for cleaning or replacement of bedding, curtains, etc. as well as for the cost of repairing any damage caused by the act of smoking in the Tents.

Burning of any materials such as mosquito coil, incense burner, paper, gas stove, etc is strictly prohibited. If traces are found from any burning materials inside and around the tent, upon check-out the registered guest will incur a cleaning fee of BND300.00.

Each facility in The Abode Resort & Spa has specific safety and security rules posted. All rules must be read and understood prior to the usage of these areas and are to be adhered by The Abode Resort & Spa guests and his/her Tent occupants. No lifeguards or security guards are posted in these areas at any time. Adults are to ensure children are supervised at all times in these areas. The Management of The Abode Resort & Spa will not be liable for any incidents resulting in bodily injury or death to person(s) or loss and/or damage to property.

The registered Guest will be liable for charges due from any damage/loss to the property at The Abode. This is applicable to all common property, third-party property or any other properties within the premises.

Guests are to refrain from inviting visitors/unregistered guests to the Tents or common facilities at any time. Any visitors/unregistered guests found may be escorted off the premises at any time.

Please note that the following are not permitted on the premises at any time:

Pets or other animals;
-
Gunpowder, fireworks, corrosive or flammable liquids or other explosives or flammable items;
-
Items emitting foul odour including but not limited to durian, chempedak, nangka, etc.;
-
Firearms and weapons;
-
Unusually large items or excessive quantities of any items; and
-
Illegal drugs or other items prohibited by law.
-
Please note that gambling or other acts which are contrary to good morals and are prohibited by law, are not to be carried out within the premises.

Please do not hang any items or objects visible from the windows or balconies of the Tents.
-
Please refrain from using the fixtures and fittings provided for purposes other than those intended.
-
Please note that there will be no unauthorized publication of images of The Abode Resort & Spa and its premises on print or digital media or using photographs and videos for business purposes, without prior written approval from the Management. Failure to observe this privacy condition may result in legal action.
-
Please refrain from placing items in common areas, lobby or passageways, except for areas within the Tents.
-
Except in emergency situations, please refrain from obstructing the emergency passageways. Please refrain from entering any service areas and back-of-house areas, whether restricted or not as these areas may be dangerous to persons, property or third-parties.

Please review the emergency exit instructions posted on the inside of the Tent promptly upon arrival.

Parking
The Abode Resort & Spa is located within 10 minutes drive from SOAS Bridge, heading towards Bangar town. You can find us on Google Maps - https://goo.gl/maps/aYbKVWdsBdmnh7W7A
Upon arriving at The Abode, parking is available on the property. Please park your vehicle at the car park. We have a shuttle service station ushering all guests to the Reception by buggy.
Luggage Drop-Off
Before parking your vehicle, you may wish to drop off your luggage at the Shuttle Service station. A luggage tag will be presented to you and your luggage will be sent to your tented villa.
Brunei Darussalam’s road traffic regulations and signs apply to parking at The Abode Resort & Spa. You are required to follow The Abode Resort & Spa employees instructions to prevent traffic flow issues within the designated parking area. Please ensure that doors, trunk department, windows and/or sunroof of your car are closed and that no objects are visible before leaving the vehicle. The Abode Resort & Spa accepts no liability for damage caused by unforeseeable events such as storms, hailstones, explosions and fire, nor does The Abode Resort & Spa accept liability for theft or damage caused by third parties.

Accessibility and Special Needs
To enhance the comfort and convenience of guests, there is a handicap and wheelchair-accessible washroom at the main restaurant.

Noise Policy
The Abode Resort & Spa has a strict ‘No Party’ Policy to ensure maximum comfort for all our in-house guests. Any person found to be creating excessive noise and disturbance, having a party or exceeding the maximum allowable occupancy of the Tent will be asked to leave the premises immediately and without refund. Please note that Guests are to refrain from inviting visitors/unregistered guests to the Tents or common facilities at any time. Any visitors/unregistered guests found may be escorted off the premises at any time.
Force Majeure
Neither Party will be liable for its failure to perform or for the delayed performance of its obligations, if such failure is a result of circumstances beyond the affected Party’s reasonable control, including but not limited to supplier strikes, lock-outs and labour disputes, act of God(s), war, riot, civil commotion, acts of terrorism, malicious damage, compliance with any law or governmental order, rule, regulation or direction not in force on the Effective Date, accident, fire, flood or severe weather conditions (“Event of Force Majeure”). Each Party agrees to give the other Party prompt notice, containing sufficient details, of any Event of Force Majeure. If an Event of Force Majeure continues for more than ninety (90) working days, either Party have the right to terminate, without further liability to the other.
Pricing Errors
The Abode Resort & Spa and its affiliates reserves the right to cancel contracts based upon incorrect information being displayed in relation to price or service at any point in time.

Insurance
The Abode Resort & Spa strongly recommend that guests purchase Comprehensive Travel Insurance. We suggest that the policy includes, but is not limited to, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, loss of money, and medical expenses.
Disputes and Claims
Any controversy, dispute, or claim arising out of or in connection with The Abode Resort & Spa policies shall come under the jurisdiction of the most competent official courts of Brunei Darussalam.

Disclaimers
As a condition of your use of The Abode Resort & Spa Website, you warrant that you will not use The Abode Resort & Spa Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Although The Abode Resort & Spa may from time to time monitor or review discussions, chats, postings, transmissions, etc. on The Abode Resort & Spa Website, The Abode Resort & Spa is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on The Abode Resort & Spa Website. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Limitation of Liability
Notwithstanding anything contained in these Terms and Conditions to the contrary, The Abode Resort & Spa and its affiliates shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arising out of the performance or non performance of obligations under this Terms and Conditions.

The Management of The Abode Resort & Spa reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on The Abode Resort & Spa website immediately.

SAFETY NOTICES, WAIVER AND RELEASES
Your comfort, safety and enjoyment are our main priorities. Please review the following notices carefully and use the same precautions and common sense that you would at home, during your stay at our Resort. You hereby agree that you have had access to and have read and agreed to all of the Resort’s Booking Terms & Conditions, including without limitation the provisions regarding COVID-19 Waiver and Release and the Protocols as published on the Resort’s website: www.abodebrunei.com

Safety Notice

For emergencies of any kind on the property, please contact Reception or dial (673) 7375825 to reach the Resort Operator.​

No lifeguards are on duty at the pool areas.
-
Parents and guardians are solely responsible for children. There is no substitute for parental or guardian supervision.

For safety reasons as well as concerns for our guests’ privacy, the Resort prohibits the operation or use of drones on or over any part of our estate and riverfront.

You agree to comply with the safety protocols issued by the Resort as well as those issued by the Brunei Government and Government agencies relating to COVID-19 or any other infectious diseases.

You agree to exercise due care and caution when walking around the Resort. This includes reading and adhering to all cautionary signage, watching your step, and carefully using the Resort’s stairs, paths, walkways, floors and similar areas to avoid tripping, slipping and falling, all of which may result in injury. The Resort shall not be liable for any loss or injury resulting from your failure to watch your step or use due care while walking around the Resort. If you have any doubts about a particular walkway, path, stairway, or surface, kindly seek assistance PRIOR to use or avoid that area if you have any doubt or any physical mobility or other limitations. Please be careful at all times. If necessary, seek assistance before you need it.

Rain and wet surfaces are common in a tropical environment. Any surface may be slippery when wet. Rainfall and resulting wet surfaces are deemed open and obvious conditions which you will be deemed to be aware of.

Always check the water temperature prior to using water from the sink or entering a bath or shower or pool. Water temperatures may be vert hot to help ensure proper water quality. Avoid scalding by checking water temperature before use.

Hot beverages may be very hot. Use caution to avoid spills and burns resulting from hot beverages and food items.

Water Sports Assumption of Risk and Release of Liability

The Resort offers a number of water sports activities including boat trips (hereinafter referred to as “water sport activities”).
-
You agree to use water sports equipment and facilities of the Resort and other related entities at your own risk.
-
Injury and drowning can occur even in shallow or calm waters. Buoyancy devices such as a life vest, should be worn at all times while participating in water sports activities. Never mix drinking, drugs, or medications with water sports or swimming.
-
Exposure to the sun and heat may result in sunburn, heat stroke and dehydration. Wear protective clothing and sunscreen. Drink plenty of water.

You acknowledge that swimming and water sports activities involve RISKS including but not limited to: drowning; injury; collision with other water craft, swimmers and objects; capsizing; sinking; impact with other riders and water surfaces; rope burns; slipping or falling; muscle injuries; the presence and unpredictable nature of wildlife and marine life; and other foreseeable and unforeseeable events that may result in injury or death. Many of these risks cannot be eliminated due to the nature of swimming and water sports activities.

By participating in swimming and water sports activities, you, on behalf of yourself and any minors for whom you are responsible, hereby agree to ASSUME responsibility for all such risks including any risks mentioned or not mentioned in this document.

In the event of an injury, you authorize any medical treatment and transportation reasonably necessary to address the injury or condition. You agree that you have adequate medical insurance and you agree to pay all costs of rescue, medical services, and emergency transportation. By engaging in any water sports activity you WARRANT AND REPRESENT that PRIOR TO engaging in any such activity you have received adequate training, experience and safety briefings, and have CAREFULLY READ AND UNDERSTOOD all safety signage.

Land-based Activities, Tours & Excursions Assumption of Risk and Release of Liability

Land-based activities including but not limited to the Resort activities and off-site tours and excursions, have risks that may result in loss, damage, injury, illness or death. Your participation in such activities is purely voluntary. You agree to assume all related risks. The Resort shall not be liable for any loss, damage, illness, injury or death whatsoever, resulting from such activities.

On-site activities including fitness classes, yoga, biking, sorts, gym, dancing, and all other activities have risks. You agree to read, understand and adhere to all safety signage and use due care and caution when engaging in any such activities and assume any related risks.

Food Allergies; COVID-19; Other Illnesses; Assumption of Risk and Release of Liability
​
Under no circumstances shall the Resort, its owners, employees, agents, insurers and any third party tour operators be liable for any injury, illness or losses resulting from food allergies, infectious diseases including but not limited to COVID-19, or any insect-borne or tropical disease. As a condition of checking in at the Resort or being present upon the Resort property, you acknowledge all such risks and agree to voluntarily fully assume all such risks and hold harmless the resort, its owners, officers, directors, employees, insurers and any third party tour operators and travel agents for all such risks. ​

Waiver and Release of Liability and Governing Law

In consideration for utilizing the various services, amenities, facilities and goods provided by the Resort, and as a condition of checking in at the Resort or otherwise being present upon the Resort property, you acknowledge that there are risks involved in utilizing the various services, amenities, facilities and goods provided by the Resort and voluntarily assume those risks. Furthermore, you, your heirs, executors, successors and assignees or other representatives agree to release, hold harmless, forever discharge and shall not sue or otherwise hold liable the Resort, its owners, employees, officers, affiliates, agents, insurers, suppliers, representatives, any third party tour operators and travel agents with respect to any and all action, cause of action, claims and demands relating to any injury, illness, disability, death, losses or damages of any kind or nature whatsoever arising from or caused by your use of the goods, services, amenities and facilities offered by the Resort including but not limited to the services, facilities and amenities indicated herein. This waiver extends to risks of infectious diseases including but not limited to COVID-19 as well as purchases of an off-site tour, excursion, activity or transportation arranged through the Resort’s on-site info counter or any transportation organized by the Resort on your behalf including transportation to and from the airport.

This agreement shall be legally binding and shall be governed by and construed in accordance with the laws of Brunei Darussalam. The courts of Brunei Darussalam shall have exclusive jurisdiction over any claims arising out of or in connection with your stay at the Resort. You agree that prior to submitting to the courts, any disputes arising from this agreement will be first referred to mediation in Brunei Darussalam.

By signing below you declare that you are of lawful age and legally competent to sign this waiver and release from liability agreement, and testify that you have freely signed this waiver and release from liability agreement and fully understand the terms and conditions as set out therein.

It is agreed that children/minors are the parent’s responsibility. If a participant is below eighteen (18) years of age, the parent or legal guardian must sign below. As the parent/legal guardian of the participant, by signing below, you testify that you have freely signed this waiver and release from liability agreement and fully understand the terms and conditions as set out therein.

If any provision of this agreement is found to be unenforceable or invalid, that provision shall be severed from the agreement. The remainder of the agreement will then be construed as though the unenforceable provision had never been contained herein.
COVID-19 Agreement Guest Infectious Disclaimer
With the risk of COVID-19, exposure can never be eliminated in a travel and tourism setting. While we have made the necessary investments in health and safety, staff training, equipment and products to help insure that you have a safe holiday, we also need to ensure that each guest understands and agrees to follow the following health and safety protocols while resident, in accordance with the guidelines set forth by the Ministry of Health in Brunei Darussalam in addition to any additional guidelines that they may provide later:

Sanitize hands immediately upon arrival at the resort as well as before entering each restaurant, shop, spa, pool, reception and Kids Club.

Agree to luggage sanitation on arrival.
-
Agree that the health information provided via my BruHealth app is to the best of your knowledge, accurate, truthful and correct in all respects, and that no information has been omitted.
-
Wear a face mask at all times in public areas.
-
Always seek to maintain social distancing of 2m.
-
Agree to be assessed for COVID-19 symptoms twice daily.
-
This includes assessing for flu-like symptoms, gastrointestinal symptoms (eg vomiting or diarrhea), loss of smell or taste, measurement of temperatures and other medical related questions.

Agree to promptly report any flu-like symptoms or fever that may be experienced.
-
Observe and practice the information contained within the COVID-19 information boards around the property.
-
Agree to undergo a PCR test upon request by the Ministry of Health once on the property.
-
Do not leave the Resort property during the entire stay and/or stop and exit the vehicle anywhere during the airport transfers for example at local shops, restaurants, etc.

The Abode Resort & Spa and its affiliates reserves the right to cancel contracts based upon incorrect information being displayed in relation to price or service at any point in time.
